still expected to vote on the package tonight. but the house has adjourned until noon tomorrow. kron four's dan kerman is here to tell us how this all unfolded and what going over the cliff means for many americans. >> reporter: the house's decision to delay the vote means unemployment checks for 12 million americans could stop or atleast be delayed. it could also mean that federal workers could be furloughed. >> it could also lead to layoffs of private sector employees that sell goods and services to the federal government. now earlier in the day the president was optimistic the cliff could be avoided. here's how the day unfolded. >> if republicans thing that i will continue deficit reduction with only spending cuts alone that is not how it is going to work. >> what he is saying to the republicans on both sides of the aisle, basically, to the house of representatives is take it or leave it. that is no our president should lead. that is not how the president should lead. at 4:00 p.m. eastern, the deal

was off. or at least, delayed. the house will break tonight, december 31st without voting on the fiscal cliff package. >> while we still see the there could be an agreement or no tax increases the deal will not be finalized on time because there is no deal on spending cuts. the house of representatives have gone home for the night. michael yaki will join us with the political advancements. vicki? we're following developing news tonight - with secretary of state hillary clinton. doctors say she is expected to make a full recovery, from a blood cot. which formed in a vein between her brain and skull. the clot was discovered yesterday - and is related to a concussion mrs. clinton suffered, after fainting while recovering from a stomachs virus. right now the 65-year-old is being treated will blood thinners, and is said to be in good spirits.

kron4's maureen kelly shows us what the police are doing to keep to the party safe. >> reporter: in the hours before and after the fireworks shoot into the air.sfpd will have a extra officers on the ground.with shifts overlapping during the peak party times.as well as additional help from the sherrif's dept and the chp.one major hot spot.here near the ferry building where barricades can already be seen in anticipation of the big crowds expected to watch the spectacle.but the pd's command post will be up above in one of the rooms of the nearby skyrises so they can keep an eye on the festivities from up above.here's one reveler carting home some alcohol for his party tonight.sfpd says that booze should be consumed indoors.they'll be keeping an eye out for open containers of alcohol. >> there's a zero tolerance, it's a crowded event, it's a family event we want people to come out and have a good time and enjoy themselves but drinking in public is against the law in san francisco.

the homicide rate in oakland keeps rising and tonight the person who killed a 15 year old girl is still on the lose. that girl was killed as she walked with others in a group near the oakland coliseum sunday afternoon. kron 4's j.r. stone is following the story and joins us with new information. >> the 15 year-old has been identified. just hours after the teenager wrist shot. her name wa blasting -- was a jordan. after she was- shot. a 14 year-old boy was also shot. police chief howard jordan is saying that they are doing everything. the suspect is a male teenager between a 13 years

san jose. kron four's rob fladeboe brings you up to date on homicide number 46, the mostsan jose in more than twenty >> reporter: a half-dozen patrol cars and perhaps twice that number of officers could be seen canvassing prospective witnesses here in the cordoned off summer breeze apartments on lewis road. police were called to the scene after receiving reports of a man sufffering from gunshots in the rear parking of the sprawling complex. >> tim kuchack/san jose police: >> officers responded with one adult male on the ground. with one gun shot wound. they pronounced him dead at the scene. >> reporter: police did not immediately identify the lone adult male victim. two people, described as 'persons of interest' were detained for questioning. police also said little about a motive for the shooting, except to say it is not gang-related. > lt. tim kuchack: >> at this point is still really early investigations

now for today's market update. stocks close out the year strong. fueled by early afternoon progress in budget talks in washington. on wall street. the dow jumped 166-points to end the year above 13- thousand. and snap a five day losing streak. the dow gained seven percent fo the year. to finish out the year above 3-thousand.

with just six hours until 2013. the final preperations are being made along the embarcadero in san francisco to ring in the near year. we got a look as crews set up the fireworks show on a barge. the best place to see the show is anywhere along the embarcadero waterfront. but make sure the ferry building is behind you. this year, there will be 5- thousand fireworks set off into the sky over the bay. all choreographed to music. some can go as high as 1- thousand feet into the air. >> allowed praying at the beginning of the show and a huge separate at the end with a lot more in between. the entire show lasts 15-minutes. and starts at midnight. and kron4's reggie kumar is live at the ferry building in san francisco with latest on the crowd that's starting to gather there. reggie?

a violent end to what has been a violent year as measured by homicides in the city of san jose. police were called here to the sprawling summer breeze apartments on lewis road where a man was shot and killed in the police did not immediately identify the lone, male victim and would not discuss any possible motive, except to say it is not thought to be gang-related. two people were detained for questioning in the city's 46th homicide this year, compared with 40 1991 when there were 53. new at 6. the woman accused of crashing into several pedestrians, killing one, near san francisco's twin peaks
